Scope and who we are

Fabinal LLC, referred to as “Fabinal,” “we,” “us,” or “our,” provides custom software, AI implementation, workflow automation, and related advisory services. This policy applies to personal information handled through fabinal.com, our questionnaires and contact forms, Meta Lead Ads associated with Fabinal, discovery and scheduling workflows, and our follow-up communications.

When we process personal information for a client under that client’s instructions, the client may be the controller or business responsible for that information. The client’s privacy notice may also apply.

Information we collect

Information you provide

We may collect your name, business email address, telephone number, company or role, questionnaire responses, project needs, scheduling details, and the contents of messages you send us.

Information from lead forms and advertising platforms

If you submit a Fabinal lead form on Meta or another advertising platform, we receive the information you enter along with operational metadata such as the form, advertisement, campaign, Page, source, and submission time. The platform may separately process information under its own privacy policy.

Information created during follow-up

We may record inquiry status, communication history, appointment outcomes, service interests, source attribution, and other notes needed to respond to you and operate our sales and service workflows.

Website and technical information

Our hosting and security providers may receive standard technical information such as IP address, browser and device type, requested pages, referring page, timestamps, and diagnostic or security logs. We may use essential cookies or similar technology where needed for site operation. If we introduce nonessential tracking that requires consent, we will provide the required notice and choices.

How we use information

We use personal information to:

  • respond to inquiries and provide requested assessments, action plans, consultations, or service information;
  • schedule and conduct conversations, calls, demonstrations, and project planning;
  • organize leads, maintain accurate CRM records, and coordinate authorized follow-up;
  • understand which campaigns and forms generated an inquiry and evaluate advertising performance;
  • operate, troubleshoot, secure, and improve our website, automations, and internal systems;
  • prevent fraud, abuse, unauthorized access, and other harmful activity;
  • comply with law, enforce agreements, and establish or defend legal claims.
Our operating rule

We collect information for a defined business purpose, restrict access to people and systems that need it, and avoid collecting information simply because a tool makes it available.

How we disclose information

We disclose personal information only as reasonably necessary for the purposes described in this policy, including to:

  • Infrastructure and operations providers that support hosting, databases, email delivery, CRM, scheduling, communications, security, and automation. These may include Vercel, Supabase, Resend, HighLevel or LeadConnector, and similar providers configured for Fabinal.
  • Advertising and lead platforms, including Meta, when needed to operate lead forms, understand attribution, retrieve a lead you submitted, or comply with platform requirements.
  • Authorized contractors and professional advisers who support Fabinal and are expected to protect the information they receive.
  • Authorities or other parties for legal and safety reasons when we reasonably believe disclosure is required by law or needed to protect rights, safety, systems, or users.
  • A successor in a business transaction if Fabinal is involved in a merger, financing, acquisition, reorganization, or sale of assets, subject to appropriate safeguards.

Service providers may process information in the United States or other locations where they operate. Their own terms and privacy notices govern information they collect for their independent purposes.

No sale of personal information

Fabinal does not sell personal information for money. We do not knowingly sell or share the personal information of anyone under 16.

Some privacy laws define “sale” or “sharing” broadly to include certain advertising technology disclosures. If our practices change in a way that creates an opt-out right, we will update this policy and provide the required method to exercise that right.

How long we keep information

We retain personal information only as long as reasonably necessary for the purpose for which it was collected, including responding to an inquiry, maintaining an active business relationship, measuring campaign effectiveness, meeting legal and accounting obligations, resolving disputes, and protecting our systems.

Retention may vary based on the nature of the information, whether you become a client, the status of an inquiry, legal requirements, and whether the information is needed for security or dispute resolution. When information is no longer needed, we delete it, de-identify it, or place it beyond active use as appropriate.

How we protect information

We use administrative, technical, and organizational safeguards designed to protect personal information. These include access controls, server-side secret storage, limited system permissions, encrypted transmission where supported, and operational logging. No system can guarantee absolute security, and we cannot promise that information will never be accessed, used, or disclosed improperly.

International transfers

Fabinal and its providers may process personal information in the United States and other countries that may have different data protection laws from your country. Where required, we use recognized safeguards for international transfers and take steps designed to protect information consistently with this policy.

Your privacy choices and rights

Depending on where you live and subject to applicable exceptions, you may have the right to request access to personal information, correction, deletion, restriction, portability, or information about how it is used and disclosed. You may also have the right to object to certain processing, withdraw consent, opt out of qualifying sale or sharing, limit certain uses of sensitive personal information, and receive equal service when exercising privacy rights.

California residents may request the categories and specific pieces of personal information collected, the sources and purposes for collection, and the categories of recipients. They may also request correction or deletion and may opt out of a qualifying sale or sharing. Fabinal does not sell personal information for money.

Residents of the EEA or United Kingdom may also object to direct marketing, lodge a complaint with their local data protection authority, and exercise rights concerning automated decisions that produce legal or similarly significant effects. Fabinal does not use lead information to make solely automated decisions with legal or similarly significant effects.

To submit a request, email hello@fabinal.com with “Privacy request” in the subject line and describe the request. We may ask for information reasonably necessary to verify your identity and protect against fraudulent requests. You may use an authorized agent where applicable law permits.

Email, calls, and text messages

If you ask us to contact you, we may respond using the contact information you provide. We send promotional email or text messages only where permitted and with any consent required by law. You can unsubscribe from promotional email using the link in the message, reply STOP to an eligible automated text program, or contact us. We may still send non-promotional communications needed to respond to a request or manage an active service relationship.

Children

Fabinal’s website and services are intended for businesses and adults. They are not directed to children, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us so we can review and delete it as appropriate.

Third-party services and links

Our website and communications may link to services we do not control, such as Meta, scheduling platforms, or other business tools. Their privacy practices are governed by their own policies. Review those policies before providing information directly to a third party.

Changes to this policy

We may update this policy as our services, systems, or legal obligations change. We will post the revised policy at this URL and change the effective date above. If a change materially affects how we use previously collected personal information, we will provide additional notice when required.
